User content
“User Content” pertains to any media, information, design, material, listing, post, comment, or any other interaction made by the User on The Website. As a user, you understand that Fashion PWR can not be responsible or liable for any added User Content but that the User is solely responsible for the content they upload. You also understand that User Content shared on The Website may be viewable and consumed by others.
We reserve the right to, at any time, review and delete any material, media of any kind and information from any User, if we deem that it violates the Terms & Conditions specified here, or our guidelines, or is against the law.
We do not claim ownership of any User Content that you post on Fashion PWR Marketplace. However by submitting User Content to Fashion PWR Marketplace, you hereby grant us a nonexclusive, worldwide, royalty-free, sub-licensable and transferable license to use, reproduce, modify, adapt, publish, create derivative works from, distribute, perform and display such User Content on the Fashion PWR Marketplace and potential other services offered.
Parts of The Website may be supported by revenue from advertisement and promotions, and these may be displayed. You hereby agree that we may place such content anywhere on The Website or on, about, or in conjunction with your User Content. The manner, mode, and extent of such advertising and promotions are subject to change without prior notice. The Website, or communication you receive while using it, might include links to third-party services. You confirm that Fashion PWR not in any way holds any responsibility or commitments in relation to such third-party services. Your correspondence and business with third-party actors discovered through the service happens solely between you and the third-party. Fashion PWR will however do it’s best to show only relevant advertisement. If you see advertisement which you believe does not belong on this website, please let us know through the form available on our contact page.
Fashion PWR Content
“Fashion PWR Content” pertains to any media, which includes but is not limited to, text, images, icons, pictures, video clips, graphics, and other related media which is contained on or within The Website and related services. Unless stated otherwise, Fashion PWR Content is protected by copyright, trademark, trade dress, patent and/or other intellectual property laws. Unauthorized use of this content may violate such laws and these terms. By using the website you agree that you will not copy, reproduce, download or otherwise make an action which might be seen as attempts at exploting, profiting from or claiming ownership of, in whole or in part, Fashion PWR Content.
By adding User Content to The Website you warrant that you own the User Content posted by you on or through The Website, or otherwise have the right to grant the rights and licenses set forth in these terms. You warrant that the posting and use of your User Content on or through The Website does not violate, misappropriate or infringe the rights of any third party, including, without limitation, privacy rights, publication rights, copyrights, trademark and/or intellectual property rights. You agree to pay for all royalties, fees, and any other demands owned by reason of User Content you post on or through The Website. If you infringe other people’s intellectual property rights, we will not hesitate to disable your account when appropriate. This may result in the loss of any purchases connected to your User Account.
Basically, just don’t upload anything that you don’t own the rights to. It will be removed, and your account may be closed down as a result of it.
You agree that any feedback, suggestions, ideas or other information or materials regarding Fashion PWR Marketplace or related services which you provide, whether by email or otherwise (“Feedback”), are non-confidential and shall become the sole property of Fashion PWR. We will be entitled to the unrestricted use and dissemination of such Feedback for any purpose, commercial or otherwise, without acknowledgment or compensation to you. You waive any rights you may have to the Feedback (including any copyrights or moral rights). We appreciate hearing from users, but please do not share your ideas with us if you expect to be paid or want to continue to own or claim rights in them.
Fashion PWR Marketplace does not take part in any shipping, and there are no standard return policy for items. The policies are dictated by each vendor. Shipping and/or return policies can be arranged between users of the platform, but Fashion PWR Marketplace bears no responsibility for these arrangements between third parties. In the EU there are laws regulating the protection of consumers when buying items online from a store, but bear in mind that this does not apply to transactions taking place between two private citizens, as explained here: https://europa.eu/youreurope/citizens/consumers/shopping/guarantees-returns/index_en.htm.
Fashion PWR Marketplace does not take responsibility for any transaction of goods or assets which results from using The Website. This includes the state in which a rented/borrowed item is returned to it’s owner. Fashion PWR can not guarantee that an object is returned in the same condition as when it was turned over to another user. Of course we do not condone acting carelessly with other Users items. When renting or lending an item, you should treat it as if it was your own, and take any measures which you would take with the clothes in your own wardrobe, to give the item as long of a life span as possible. A User which repeatedly returns items in worse condition than when it was received may lose the right to access their account, if it is found that the user does this intentionally.
A user offering an item through The Website is responsible for describing the actual state of the item listed, including any damages or other information which may result in another user not wanting to finalize a transaction related to the item. Intentionally leaving information out, or otherwise adding information to the listing with the intention of deceiving a buyer / renter / etc. may result in your account being terminated.
Prohibited Activities
In addition to the other restrictions outlined in these Terms, you agree that you will not:
Breaching any of the terms stated may result in the immediate termination of your user account. Note that you will not be eligible to receive any refund for purchased products which you are no longer able to use as a result of violating the terms herein.
Fashion PWR Marketplace does not take any responsibility for activities that occur while logged into your account. You are responsible for making sure that you keep your password and/or other login measures secure and safe. You agree that you will not share your login information with others or do anything that might jeopardize the security of your account. You have to register to Fashion PWR Marketplace with your official name.
We reserve our right to access your account in cases where we suspect that the account is involved in activities breaching these terms.
In the event where you have forgotten your password and/or login details and no longer have access to your email address, we cannot give you access to the Fashion PWR Marketplace account. This includes accounts with misspelled email addresses.
Swedish law shall be applied on the services and the Terms and Conditions. Any legal dispute will be decided in swedish court.
